While no decision has been made yet regarding who would be a potential suitor, Apple&#8217;s name is being dropped alongside Microsoft, Sony, Google, Yahoo! and most likely CBS and AOL who, I imagine, would be interested in re-upping that contract.</p>
<p>The bad news for Apple here is that unlike many of their other arrangements, this isn&#8217;t a &#8220;let&#8217;s work together and all make money&#8221; kind of situation, but rather more of a &#8220;pay us a whole bunch of money for the rights to sell our content,&#8221; something that would likely be a radical change of direction for Apple.  And we&#8217;re talking about all sorts of money involved, too.  Sprint Nextel paid $600 million over five years for rights to highlights, statistics and programming from the NFL Network.  So, while it&#8217;s certainly intriguing to think of the possibilities, I think Apple is kind of a dark horse in this race.</p>

It states that season three will be available in iTunes &#8220;<em>very</em> soon &#8212; possibly in the next few days.&#8221;  It also goes on to say that &#8220;episodes of season 10 [Ed. <em>The current season</em>] should also be available on iTunes within a week of their airing on Comedy Central.&#8221;</p>

The games from the first four rounds (up to and including the Elite 8) will be made available in &#8220;condensed versions&#8221; available for purchase for $1.99 or the whole lot of them can be purchased as a &#8220;Season Pass&#8221; (different from the &#8220;Multi-Pass&#8221; announced for <em>The Daily Show</em> and <em>The Colbert Report</em> last week) for $19.99.  Going into the Final Four and the Championship game, full versions of the games will be made available for purchase.  There will also be compilations of &#8220;buzzer beaters, upsets and memorable championship games from past NCAA Tournaments&#8221; available for purchase&#8230;whatever that means.  So, if years of watching <em>SportsCenter</em> hasn&#8217;t yet sucked out all your elation of watching <a href="http://en.wikipedia.org/wiki/Jim_Valvano">Jimmy V.</a> running out on the court looking for someone to hug, then you&#8217;ll able to purchase it and watch it until you are no longer elated.</p>
<p>The NCAA tournament&#8217;s first game is tonight&mdash;the 16 seed play-in game between <a href="http://www.ncaasports.com/basketball/mens/gamecenter/preview/NCAAB_20060314_MONNJ@HAMP">Hampton and Monmouth</a> to determine who will earn the privilege of being drubbed by Villanova in the first round.  The first round will begin in earnest on Thursday and Friday.</p>
<p>Overall, this is a great content addition to iTunes.  If CBS Sports does a good job of promoting it during the games, it could be very popular, especially as we move towards the final rounds.  It&#8217;s also good news on the possibility of CBS eventually bringing other content into iTunes.  CBS Corporation is already involved somewhat through Showtime.  Hopefully, CBS may soon be bringing over some of their regular programming as well.</p>

<p>I&#8217;ll level with you.  When I first saw this <a href="http://www.macworld.co.uk/news/index.cfm?NewsID=14084&amp;Page=1&amp;pagePos=2">MacWorld UK</a> article, I was pretty darn happy.  I seriously thought that HBO was finally going to get some of their extremely-popular shows into iTunes.  I was hoping to rush right into iTunes and get the season premiere of <em>The Sopranos</em>.</p>
<p>Then I read that they&#8217;re actually only adding some <a href="http://phobos.apple.com/WebObjects/MZStore.woa/wa/viewArtist?artistId=118405710">behind-the-scenes podcasts</a> and other related paraphernalia.  Color me, and a great deal of the internet, disappointed.</p>
<p>Okay, okay.  Let&#8217;s try and look at the bright side.  Clearly HBO is considering iTunes.  They&#8217;re not quite as technophobic as FOX is&mdash;they&#8217;re taking baby steps into iTunes.  This isn&#8217;t unprecedented: VH1 and G4 are doing the same thing.  Hopefully, this is just HBO testing the waters on their way to getting <em>The Sopranos</em>, <em>Rome</em> and <em>Curb Your Enthusiasm</em> into iTunes.</p>
<p>However, my personal feelings aside, HBO feels that they have to protect their market.  When you&#8217;re in the business of convincing people to pay an extra $10-$15 per month for your programming in its entirety, allowing people to pay just $2 per show could conceivably eat into that market.  The other side of it is, of course, that while there may be some losses from people dropping the premium portion of their cable, they would easily make up for it from people like me who don&#8217;t even <em>have</em> cable and would like a <em>legal</em> outlet to get the latest episode of <em>The Sopranos</em>, short of waiting half a year for  DVDs (on top of the <em>year and a half</em> we&#8217;ve already had to wait).</p>
<p>Either way, hopefully this is a good signal (albeit a weak one) that HBO is at least thinking about this avenue.  Showtime is already convinced.  Hopefully, HBO can take the plunge soon.</p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p><a href="http://www.variety.com/article/VR1117939342?categoryid=1238&amp;cs=1&amp;s=h&amp;p=0"><em>Variety</em></a> is reporting that NBC Universal and Disney are close to a deal to put the NBC comedy series <em>Scrubs</em> for sale in iTunes.  How is Disney involved?  Well, <em>Scrubs</em> is produced by Touchstone Television, a Disney company.  The deal, which is said to be the first deal of its kind between any two conglomerates like this, is said to split the profits of the season 5 (the current one) 50-50 between the two companies through August 31 when the rights would fully revert back to Touchstone.  Touchstone would also receive all of the profits from sales of previous seasons.</p>
<p><em>Variety</em> goes on to say that one of the reasons this particular series is even able to be considered for iTunes is that <em>Scrubs</em> is already in syndication and, thus, selling the show in iTunes isn&#8217;t considered a threat to the overall long-term profitability of the show.  They also go on to say that while no one knows for sure what other series are being negotiated in this fashion, industry insiders consider <em>My Name Is Earl</em> (broadcast on NBC, produced by 20th Century Fox) and <em>House</em> (broadcast on FOX, produced by NBC Universal) are possible candidates.  I don&#8217;t know if I fully agree with those candidates, especially given FOX&#8217;s technophobic tendencies lately, but you just never know.</p>

<li>This shouldn&#8217;t be a surprise, but the <a href="http://phobos.apple.com/WebObjects/MZStore.woa/wa/viewVideo?id=121422733&amp;s=143441">Dave Chappelle</a> special has rocketed to the number one seller in videos.  It&#8217;s a trifecta of the popularity of Dave Chappelle, the popularity of a full hour of comedy and the fact that the <a href="http://www.amazon.com/gp/product/B0009VRHLU/">DVD version</a> is selling at a $14 price point.  People know a good bargain when they see it.</li>
<li>Also not a surprise, but the addition of <em><a href="http://phobos.apple.com/WebObjects/MZStore.woa/wa/viewVideo?id=129763857&amp;s=143441">The Daily Show</a></em> is also doing gangbusters, up at #4 at this time.  I have no idea whether or not the Multi-Pass sales are being factored into that total, but I imagine they are.  We&#8217;ll likely find out as time goes on when we see whether or not subsequent episodes rate high as well.</li>
<li><em><a href="http://phobos.apple.com/WebObjects/MZStore.woa/wa/viewVideo?id=129765395&amp;s=143441">The Colbert Report</a></em> is also doing pretty well, with its first episode currently at #17.</li>
<li>Speaking of both <em>The Daily Show</em> and <em>The Colbert Report</em>, both of last night&#8217;s episodes were added to iTunes fairly quickly.  This was the last potential problem with adding daily programming.</li>
<li>The <em><a href="http://phobos.apple.com/WebObjects/MZStore.woa/wa/viewAlbum?id=129731750&amp;s=143441">Law &amp; Order: SVU</a></em> episodes that were missing yesterday have finally been added.  However, season 2 of <em>SpongeBob SquarePants</em> is still missing in action.</li>
</ul>
<p>Finally, from the &#8220;neither here nor there&#8221; department, every once in a while I&#8217;ll trawl the comments on shows just to see what&#8217;s out there because so many of them are so inane, pointless and completely unrelated to the show itself (like people begging Apple to add particular shows, as if it were entirely up to them).  However, I found one that takes the cake:</p>
<blockquote><p><em>Wheres RENO 911 and newer seasons of SOUTH PARK.  Apple keeps putting on crappy shows on itunes that no one wants to buy!  Plus when are they going to put MOVIES on ITUNES!!!!!!</em></p></blockquote>
<p>Setting aside the fact that he is clearly not a reader of this site (and the fact that the entire quote should be proceeded by a large &#8220;[sic]&#8220;), how selfish do you have to be to give a one-star rating to a show because it&#8217;s not something <em>you</em> want.  And then claim that no one else wants it because you don&#8217;t want it (despite the fact that it&#8217;s an immediate top seller).</p>
<p>So there you are, &#8220;drewman&#8221; apparently wants <em>Reno 911!</em> in iTunes&#8230;and movies.  You heard it here first, guys!</p>

The television series added would include <em>Surface</em>, <em>Battlestar Galactica</em> and <em>Alfred Hitchcock Presents</em>.</p>
<p>Obviously, this would be the first time that iTunes would launch television shows in a country other than the U.S.  The UK was the best candidate for the first non-American nation to start receiving television series, as it is the oldest English-speaking store outside of the U.S.</p>

It&#8217;s also worth mentioning that ABC is not planning on doing this <em>instead</em> of selling through iTunes, but as a counterpart to it.</p>
<p><a href="http://macdailynews.com/index.php/weblog/comments/hollywood_unions_cry_foul_over_apple_itunes_store_abc_tv_shows_deals/">MacDailyNews</a> is reporting (through the <em>Los Angeles Times</em>) that actors, writers and directors and their unions are criticizing how ABC is paying royalties to them for online downloads through iTunes.  ABC apparently uses the same formula as it uses for home video, where 20% of the revenue is sent to the actors, writers and directors involved and 80% goes to paying for the production costs, manufacturing and so on.  The unions see this as shortchanging the people they represent.</p>
<p>Finally, continuing what I mentioned yesterday about the <a href="http://itvs.wordpress.com/2006/03/01/a-few-wednesday-tidbits/">top sellers from the latest additions</a>, the Dave Chapelle <em>Inside the Actors Studio</em> has become the fifth most popular download among videos while Carlos Mencia&#8217;s stand-up comedy has moved into the number seven slot.</p>

They&#8217;ve discovered some additional information to what <a href="http://itvs.wordpress.com/2006/03/02/apple-movie-store-really-is-coming-soon/">AppleInsider reported on</a>.  The most critical piece of information is that the monthly fee plan is being pushed exclusively by the motion picture industry and not Apple.</p>
<p>Also, iLounge is reporting on a <a href="http://ilounge.com/index.php/news/comments/sci-fi-channel-tv-guide-team-up-for-itunes-giveaway/">TV Guide giveaway</a> of free <em>Battlestar Galactica</em> episodes in this week&#8217;s magazine. 			<content:encoded><![CDATA[<div class='snap_preview'><br /><p>Here&#8217;s some interesting news from <a href="http://www.appleinsider.com/article.php?id=1567">AppleInsider</a>.  They are reporting that it appears as if Apple is getting market research to gauge interest in purchasing and downloading movies online.  One interesting aspect is that the survey speculates whether or not people would be interested in subscribing to a service with a $9.99 monthly fee that would net the user unlimited downloads (minus DVD burning capabilities) or whether or not the user would be interested in a $12.95 per movie cost to burn the movie to DVD.</p>
<p>There are so many things to comment on here.  The first is the most obvious, that Apple is apparently looking at a monthly subscription rate for the first time ever in the history of iTunes.  However, this is also the time where it seems to make the most sense.  Paying $9.99 per movie would be almost ludicrous for the lower quality and feature rate of an online download.  Now, as a monthly fee with unlimited downloads, this is a price point that consumers and the motion picture industry can probably agree on.  It does raise an interesting concern, however.  WMP-based MP3 players that subscribe to services like Napster are required to connect to the computer on a regular basis to verify that the user is still subscribed.  Likely, Apple would need to require something similar in this instance.  This is an unfortunate side effect of subscription-based services.</p>
<p>Piracy is probably a moot point in all this.  The level of quality from a download is not going to be enough to compare with downloads that already exist online and the cost to purchase a movie that can be burned to DVD is comparable to that of a DVD purchased in a store.  Piracy is no better or worse a factor than it was before, which would satisfy the desires of the motion picture industry.</p>
<p>Also interesting to note is the list of movies that would be offered.  The first thing I noticed about the list were that the movies were not of things that have been offered on DVD recently.  There are no movies listed that were released on DVD in 2006 and most were from the early part of 2005.  This makes me wonder when this survey was put together.  I don&#8217;t doubt the veracity of the survey, but it does make me stop and wonder why.  I don&#8217;t have a good theory as to why this is.  As far as the studios involved in this, AppleInsider points out Miramax, Buena Vista, Universal, New Line Cinema and Sony Pictures appear to be involved just based on the list of titles there.  Miramax, Buena Vista and Universal all jive with companies already committed to iTunes.  New Line Cinema is owned by Time Warner and Sony Pictures is obviously owned by Sony.  Absent from the list are 20th Century Fox, the Viacom studios, Paramount and Dreamworks and other independent studios like Lion&#8217;s Gate and Magnolia, although the only thing we can truly discern from the list is that it is obviously incomplete and thus we can&#8217;t possibly know what other studios may be involved.</p>
<p>Finally, what can we learn from a potential timeframe here?  Well, online surveys are typically run in one of two ways.  Either they are trying to gauge market response for a particular product they <em>may</em> launch or that they <em>will</em> launch.  It&#8217;s usually pretty easy to spot the differences in the two.  If it&#8217;s a product that they are uncertain about launching, it typically will have very vague descriptions and will attempt to gauge reaction to multiple possibilties from the survey taker.  If the product is already being prepped for launch, they will typically be looking for information about things like package design, response to advertising, price points, and so on.  Based on this, I would have to say that Apple is really far down the road with this and they are not just trying to determine whether or not this is a project they should pursue.</p>
<p>So, just how far along is Apple with this?  Well, these types of surveys tend to occur relatively late in a product development cycle and not very far from product launch, usually a few months.  After all, as time goes on, people&#8217;s opinions change based on comparable products from competitors and a company generally wishes to launch with as accurate a data response set as possible.  Let&#8217;s say, just for example, that Microsoft were to release a movie download service at a $6.99/month price point between now and when Apple launched their service.  Suddenly, price point data submitted by the survey takers would no longer be valid.</p>
<p>To give a comparable example for timeframe, surveys about DVD launches (for example, trying to find out if packaging is appealing) typically occur shortly after the movie is released in theaters.  This gives the company sufficient time to go through their findings and make any necessary changes prior to beginning production and distribution of the DVDs.</p>
<p>So, when is Apple really going to be releasing the iTunes Movie Store?  Well, the upcoming 30th Apple Anniversary in April is probably way too early.  You wouldn&#8217;t be submitting surveys a month before product launch.  Not enough time.  The WWDC in June isn&#8217;t really the kind of event you&#8217;d launch something like this at and will likely be reserved for the last of the Intel-based computers (the G5 replacement, probably) and maybe Mac OS X 10.5 Leopard.  Besides, to launch something like this you need a new iPod: one with improved screen resolution, hard drive capacity and longer battery life.  So, maybe we should look at the iPod development cycle.  The current 5G iPod was released in October 2006 and Apple usually leaves an iPod out there for at least a year.  So, I&#8217;d say that the earliest we could see an iPod Movie Store would be in October.  This actually makes perfect sense.  It&#8217;s right before Christmas and it&#8217;s towards the end of the iPod development cycle.  It would be the perfect time to release the companion iTunes Movie Store.</p>
<p>So, perhaps I could be made out for a fool for going out on a limb here, but barring any unusual developments, I would expect an iTunes Movie Store sometime around October of this year.  It just makes the most logical business sense to me.</p>
<p>But, please, no hate mail if I&#8217;m wrong, OK?</p>
